HON'BLE SRI JUSTICE S. RAVI KUMAR TRANSFER C.M.P.No.405 of 2016 ORDER:

This petition is filed to withdraw H.M.O.P.No.12 of 2016 from the file of Senior Civil Judge Court, Bhimavaram, and transfer the same to Senior Civil Judge Court, Guntur for disposal in accordance with law.

Petitioner herein is wife. According to the affidavit filed in support of petition, marriage of petitioner with respondent was solemnized on 24.08.2013 at Bhimavaram as per Hindu rites and caste customs and during their wedlock, one male child was born on 16.08.2014 and due to the harassment caused to her, she is staying in her parents house at Guntur. It is stated that respondent filed O.P.No.12 of 2016 before Senior Civil Judge, Bhimavaram for divorce with all frivolous and untenable allegations, distance from Bhimavaram to Guntur is 200 kilometers and it is difficult to her to travel from Guntur to Bhimavaram with small child and that there are none to accompany her. It is stated that respondent is working at Hyderabad as software engineer and in fact Guntur is convenient for him in stead of Bhimavaram. For these reasons, she prayed for transfer of H.M.O.P.No.12 of 2016 from Senior Civil Judge Court, Bhimavaram to the Court at Guntur having competent jurisdiction. 3.

Respondent in spite of service of notice neither appeared in person nor through any advocate.

Considering the reasons stated in the affidavit and also convenience of wife, O.P.No.12 of 2016 is withdrawn from Senior Civil Judge Court, Bhimavaram, and transferred to Family Court, Guntur, for disposal in accordance with law.

Transfer C.M.P. is ordered accordingly. No costs. 7.
