THE HONOURABLE SRI JUSTICE M.GANGA RAO WRIT PETITION No.7256 of 2007 ORDER:

This writ petition is filed to declare the proposed action of the respondents in widening the existing road from 100 feet to 200 feet from Location Point Nos.317 to 319 at bypass road, Puttur Town, Chittoor District on National High Way by widening more feet on north-eastern and eastern side of the existing 100 feet by proposing to widen lesser feet on the other side of the road on those said points as illegal, arbitrary, malafide and consequently direct the respondents to widen the road by equally widening on either side of the road at Location Point Nos.317 to 319 on the National High Way at Bypass road, Puttur Town in Chittoor District.

The claim of the petitioners is that they are owners of the land situated near the bypass road, Puttur town in Chittoor district. The properties of petitioners are abutting to 100 feet road existing on its north eastern side located at Location Point Nos.317 to 319.

The main grievance of the petitioners is that at location Point Nos.318 and 319 near the crossing of Putturu Pillari Pattu Road, the respondents proposed to widen the road by 148 feet on its eastern side which is 98 feet more to usual 50 feet widening, whereas on its other side, the respondents proposed to widen the road have proposed to widen 22 feet road which causes severe loss of land to the petitioners.

The respondents filed counter. The learned Assistant Government Pleader on getting instructions, stated that the grievance of the petitioners that their rights are being infringed is hypothetical. He further stated that the roads are laid as per the approved plans and as per the road geometrics. As the respondents have completed the widening by laying the roads and compensation is also paid to the petitioners, no cause of action survives in the writ petition, for adjudication. Accordingly, the writ petition is closed. No order as to costs. Consequently, miscellaneous petitions, pending if any, shall stand closed.
