HIGH COURT OF JUDICATURE AT HYDERABAD FOR THE STATE OF TELANGANA AND THE STATE OF ANDHRA PRADESH PRESENT THE HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.7809 of 2002 DATED: 18.09.2015 Between:

Medapati Veerareddy and others ... Petitioners and Gram Panchayat ... Respondent

THE HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND THE HON'BLE SRI JUSTICE S.V.BHATT

WRIT PETITION No.7809 of 2002 ORDER: (per the Hon'ble The Acting Chief Justice Dilip B. Bhosale) This Writ Petition was filed in 2002 challenging the notice demanding property tax under the provisions of Andhra Pradesh Panchayat Raj Act.

Though the Writ Petition was filed in 2002, interim order was not passed by this Court.

Learned counsel appearing for parties are not in a position to state whether the tax has been recovered from the petitioners or not. Keeping that in view and considering the provisions contained in Section 135 of the said Act, we dispose of this Writ Petition with the following order:

"The respondent may recover the tax on the basis of the impugned demand notice to the extent law permits, and even for taking further steps in that regard, the respondent shall follow the due procedure contemplated under the provisions of the said Act and the principles of natural justice."

Consequently, miscellaneous petitions, if any, also stand disposed of. No order as to costs.
