THE HON'BLE SRI JUSTICE C.PRAVEEN KUMAR WRIT PETITION No. 21888 of 2016 ORDER :

This Writ Petition came to be filed with the following prayer:

"...to pass an order, or orders, direction or directions, or issue a writ, more particularly in the nature of Writ of Mandamus directing the respondent No.1 to 3 herein that not to interfere with the peaceful possession and enjoyment of petitioner's open plot bearing No.225 situated at Sy. No.1009, Phase-VI, Kukatpally village, Balanagar Mandal, District Ranga Reddy and construction work of erection of boundary wall, underground drainage system between plot no.224 & 225; coming under the influence of respondent no.4 & 5 herein and consequently declare the said action of respondents in interfering in the peaceful possession and enjoyment of petitioner's open plot no.225 and interfering in civil disputes is illegal, arbitrary, violative of Article 14, 21, of the Constitution of India, and pass..."

2. Heard the learned counsel for the petitioner and the Assistant Government Pleader for Home for the State of Telangana appearing for respondents 1 to 3. At their request, the Writ Petition is taken up for disposal at the admission stage. Since this Court is not adjudicating the case on merits, it may not be necessary to hear respondents 4 and 5.

3. The case of the petitioner is that he is owner of plot No.225 situated in survey No.1009, Phase-VI, Kukatpally

village, Balanagar Mandal, Ranga Reddy District, and respondent No.4 is owner of plot No.224 situated on the northern side of his plot. There was a dispute between him, on one hand, and respondents 4 and 5, on the other, with regard to construction of compound to his plot on northern side. It is his grievance that the official respondents, at the instance of respondents 4 and 5, are interfering in the civil dispute and insisting the petitioner to stop the construction work.

4. Learned Assistant Government Pleader, on instructions, states that the allegations made in the Writ Petition are false and any act done by the police would be in accordance with law.

5. Recording the said statement, the Writ Petition is disposed of making it clear that any action taken by the police shall be in accordance with law. Miscellaneous petitions pending, if any, in the Writ Petition shall stand closed in the light of this final order.
