HONOURABLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.3352 of 2018 ORDER:

Heard the learned counsel for the petitioners. This Criminal Petition is disposed of at the admission stage. It is informed to this Court that petitioners/A.1 to A.5 are being accused of the offences under Section 498-A of I.P.C. and Sections 3 and 4 of the Dowry Prohibition Act in Crime No.262 of 2013 of Rajendra Nagar Police Station and the charge sheet is filed and case is registered as C.C.No.1133 of 2015 and posted for framing of charges.

In view of the stage of the case, this court considers it not fit to entertain the quash petition at this stage.

Instead, petitioners are given liberty to approach the trial court and seek to discharge them if they are so advised in which case the trial court shall pass appropriate orders on merits thereon. Having regard to the submission of the learned Counsel for the petitioners that all the petitioners are residents of Kanpur and it is causing much hardship for them to attend before the trial court, the presence of petitioners/A.2 to A.5 before the trial Court is dispensed with except on the occasions when the trial court considers their appearance necessary.

This Criminal Petition is disposed of accordingly.

As a sequel, miscellaneous applications pending if any, shall stand closed.
