THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No. 24390 of 2004 ORDER:

The grievance of the petitioner in this case was with regard to the action of the respondents in digging a well under the Rural Water Supply Scheme in his land. He sought for a consequential direction to the respondents to close the said well.

This Court, by order dated 28.12.2004, directed status quo obtaining as on that date to be maintained. While so, a counter affidavit was filed by the Mandal Revenue Officer, Thimmapur Mandal, Karimnagar District, stating that the subject bore well was dug on the margin of the road leading from Gollapalli to Laxmidevipalli outside the fencing erected by the petitioner surrounding his land. No reply affidavit has been filed by the petitioner rebutting this averment. Further, there is no representation for the petitioner or his learned counsel though the matter has been pending on the file of this Court for over a decade. It is therefore clear that the petitioner is not interested in prosecuting his case.

The writ petition is accordingly dismissed for default. Interim order dated 28.12.2004 shall stand vacated.

Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
