HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 8721 of 2016 O R D E R:- Heard learned Counsel for the petitioner and learned Government Pleader for Civil Supplies appearing for the respondents.

The case of the petitioner is that he was appointed as Dealer of Fair Price Shop No.0915 of Indurthi Village, Chigurumamidi Mandal, Karimnagar District. While so, on 08.12.2015 the Deputy Tahsildar (CS), Huzurabad, along with the Circle Inspector (Vigilance and Enforcement), Karimnagar, inspected the shop and found certain irregularities and submitted a report on 11.12.2015. Based on the said report, the 2nd respondent issued a show cause notice to the petitioner on 31.12.2015 calling upon him to explain the reasons as to why his authorization should not be cancelled, within seven days from the date of receipt of the notice, for which he submitted explanation on 13.01.2016. But however, on the date of issuance of the show cause notice itself, the 2nd respondent suspended his authorization, pending enquiry. Aggrieved by the same, he filed the present writ petition.

A perusal of the record shows that on 31.12.2015, the 2nd respondent issued a show cause notice to the petitioner

and suspended the authorization of his Fair Price Shop on the even date on the allegations that there are certain variations in the stocks and the petitioner indulged in clandestine business without taking into consideration the explanation of the petitioner. In view of the same and inasmuch as the petitioner already submitted his explanation to the show cause notice, interest of justice would be served, if the 2nd respondent is directed to conduct an enquiry against the petitioner by taking into consideration the explanation submitted by him.

Accordingly, the 2nd respondent is directed to complete the enquiry by taking into consideration the explanation submitted by the petitioner and pass final orders within a period of four weeks from the date of receipt of a copy of this order, by duly observing the principles of natural justice and affording an opportunity of being heard to the petitioner.

Subject to the above, the Writ Petition is disposed of at the admission stage. Consequently, miscellaneous petitions pending if any in the Writ Petition shall stand closed. No order as to costs.
