THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.12203 of 2005 ORDER:

Heard the learned counsel for petitioner. None appears for the respondents.

2. The petitioner submits that she is the absolute owner of Ac.1.77 cents situated in survey No.53/1, 53/2 in Mandavalli Village, Mandavalli Mandal, Krishna District. She stated that she purchased the said land from one Bottchu Satyanarayana and G.Ramachendrarao under an agreement of sale dated 12.10.1974. She also stated that she purchased the said land prior to passing of the A.P. Assigned Lands (Prohibition of Transfers) Act, 1977. The vendor in the said agreement of sale purchased the said land from Ex-serviceman Sri Matta Yohan in the year 1970. Whileso, the third respondent issued a notice on 28.05.2005 under Rule 3 of the Andhra Pradesh Assigned Lands (Prohibition of Transfers) Act, 1977, to which the petitioner submitted reply on 03.06.2005. It is the case of the petitioner that without passing any orders thereon, the third respondent is interfering with the possession of the petitioner.

3. No counter affidavit was filed by the respondents so far.

4. In the circumstances, this Writ Petition is disposed of directing the third respondent to pass appropriate orders pursuant to the notice dated 28.05.2005 by taking into consideration the explanation submitted by the petitioner on 03.06.2005.

Till the order is passed thereon, the possession of the petitioner shall not be interfered with. There shall be no order as to costs.

Miscellaneous petitions pending, if any, in the Writ Petition shall

stand closed.
