THE HON'BLE SRI JUSTICE M. SATYANARAYANA MURTHY CRIMINAL PETITION No.15029 OF 2016 ORDER:

This Criminal Petition, under Section 482 of the Code of Criminal Procedure, 1973 (for short, 'Cr.P.C.'), is filed by the petitioner to quash the proceedings in C.C. No.1133 of 2014 pending on the file of Junior Civil Judge, Vuyyuru, Krishna District on various grounds.

However, during hearing, Sri Sravan Kumar Naidana, learned counsel for the petitioner, requested to pass an order dispensing with the appearance of the petitioner before the Judicial Magistrate of First Class, Vuyyuru, Krishna District, as he is working as a Clerk in REPCO Bank, Visakhapatnam. But this Court cannot exercise jurisdiction of Judicial Magistrate of First Class, however, the petitioner is permitted to file an appropriate application under Rule 37 of Criminal Rules of Practice or under Section 205 Cr.P.C. or under any other provision of law, to dispense with the appearance of the petitioner on the date of adjournment, after due service of notice on the Public Prosecutor.

On filing such application, the learned Magistrate is directed to decide the same on the same day.

Accordingly, the criminal petition is disposed of. Miscellaneous petitions, if any, pending in this criminal petition, shall stand closed.
