HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 4008 of 2017 ORDER:

The grievance of the petitioner is that respondent No.4 is making construction on the terrace of premises bearing municipal No.6-3-456/A/20, Dwarkapuri Colony, Panjagutta, Hyderabad, without there being any sanction or permission from the authorities concerned. Petitioner asserts that, on earlier occasion, when a similar attempt was made, she filed W.P.No.3066 of 2010 and, this Court, by order dated 15.02.2010, disposed of the Writ Petition on the assurance given by the authorities that action had already been initiated by issuing notices under Sections 452 and 636 of the Greater Hyderabad Municipal Corporation Act, 1955 (the Act). Thereafter, respondent No.4 had stopped construction. However, once again, the petitioner started dumping material in the month of January, 2017.

It is the assertion of the petitioner that no permission was granted by the respondent - authorities to carry on construction on the terrace of the building. Learned Standing Counsel for Greater Hyderabad Municipal Corporation would submit that action would be taken in accordance with law, and objections of the petitioner shall also be considered.

In the light of the submission made by the learned Standing Counsel, the Writ Petition is disposed of with a direction to the respondent - authorities not to permit any construction by respondent No.4 without there being sanction or permission under the Act and shall also consider the objections raised by the petitioner. Miscellaneous petitions pending, if any, shall stand dismissed. No order as to costs.
