THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.5330 of 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:

"to issue writ of Mandamus to declare the inaction of the Respondent No. 2 and 3 in pursuance of the Petitioner's notice dated 22-12-2015 are concerned, action of the Respondent; No.2 and 3 exercised their power on the face of it discriminately among the seven casual employees and the other 2 causal employees have been working as Contract Labourers working in examination branch as highly illegal, arbitrary, unconstitutional, irrational and In violation of University Rules in force and Article 14 and 16 of Constitution of India and to consequently direct the Respondent Nos.2 and 3 herein to forthwith continue/reinstate the petitioners into service as casual employees working In examination branch, Kakatiya University."

Heard, Sri Ram Prasad Pathipaka, learned counsel for the petitioners and learned Government Pleader for Higher Education for respondent No.1 and Sri Venkateshwar Rao, learned Standing Counsel for respondent Nos.2 and 3, apart from perusing the material available before this Court.

At the Bar, it is represented by learned counsel for the petitioners that for redressal of the grievance of the petitioners, the petitioners herein submitted a representation, dated 22-12-2015 and a copy of the same is also placed on record along with the writ petition as a material paper.

Having regard to the facts and circumstances of the case,

this Court is of the considered opinion that the ends of justice would be met if a direction is issued to the respondents herein to consider and pass appropriate orders on the said representation, in accordance with law, by fixing some timeframe. For the aforesaid reasons, without entering into the merits and demerits of the matter and entitlement of the petitioners, the writ petition is disposed of, directing the respondents to pass appropriate orders on the representation, dated 22-12-2015 said to have been submitted by the petitioners, in accordance with law, within a period of two (2) months from the date of receipt of a copy of this order.

Miscellaneous Petitions pending, if any, shall stand closed. There shall be no order as to costs.
