HONOURABLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No.10469 of 2019 ORDER:

This writ petition, under Article 226 of the Constitution of India, is filed by the petitioners seeking the following relief: "For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue a Writ of Mandamus, or any other appropriate writ, order or direction, declaring the action of the 2nd respondent in seizing the vehicle No.TATA 207 RX Model registration No.KA33A 0106 and the stock covered under invoice E-Way Bill No.191122887182 in Cr.No.23/2019, dated 25.4.2019 under Sec.188, 273, 270 IPC & Sec.20(2) of C.T.P.P.A.R.T.C.P.S.D. Act against the petitioners No.1 & 2 and seizing the vehicle TATA 207 RX Model registration No.KA33A 0106 and the stocks though the petitioners have valid documents to show that they are transporting the goods from one place to another place at Karnataka State wherein the goods are not prohibited as illegal, arbitrary and without jurisdiction and pass such other order or orders as may deem fit and proper in the circumstances of the case."

Heard learned counsel for the petitioners and learned Government Pleader for Home for respondent Nos.1 and 2 and perused the material on record.

Learned counsel for the petitioners submitted that the vehicle is already produced before the Judicial Magistrate of First Class, Narayanpet, on 20.05.2019.

Recording the said submission, the writ petition is disposed of granting liberty to the petitioners to move an application before the

Judicial Magistrate of First Class, Narayanpet, for release of the subject vehicle. There shall be no order as to costs. Miscellaneous Petitions, if any, pending shall stand closed. ________________________ A. RAJASHEKER REDDY 29th May, 2019.
