ORDER
This Criminal Petition is filed praying this Court to enlarge the petitioner on bail who is arrayed as accused No.1 in Crime No.217 of 2026 before the Bachupally Police Station,
Cyberabad Commissionerate, registered for the offence punishable under Sections 64, 75, 77, 123 and 351(2) of BNS. 2.
The case arises out of a complaint lodged on 28.02.2026 at Bachupally Police Station by the mother of the victim, alleging that the petitioner, a fellow student, developed acquaintance with the victim through Instagram and, under emotional pressure, subjected her to repeated sexual exploitation from August 2024 onwards. It is further alleged that the petitioner administered certain substances causing drowsiness, threatened the victim with circulation of private photographs, and exploited her at various places including college premises and other locations. Based on the said complaint, a case was registered and the petitioner was arrested.

Heard Sri K. Uday Kanth, learned counsel appearing on behalf of the petitioner as well as Sri M. Ramachander Reddy, learned Additional Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioner submitted that the allegations are false, fabricated, and arise out of a consensual
relationship between two major students which later turned sour. He further submitted that all interactions and physical relations were with the free consent of the victim and continued for a long period without any complaint. The allegations regarding coercion, administration of substances, dark web links, and trafficking are baseless and unsupported by any evidence. He contended that there is inordinate delay in lodging the complaint, no medical or corroborative evidence is produced, and the entire case rests on unsubstantiated allegations. The petitioner is a young student with no criminal antecedents, has been in custody for several weeks, and his continued detention is unnecessary. Therefore, he prayed the Court to grant bail to the petitioner by allowing this Criminal Petition.

On the other hand, learned Additional Public Prosecutor opposes the bail application, contending that the allegations disclose serious offences involving repeated sexual exploitation, criminal intimidation, and abuse of trust and that the victim has given a detailed account of coercion, threats, and administration of substances, which requires thorough investigation. At this stage, granting of bail to the
petitioner does not arise. Therefore, he prayed the Court to dismiss the criminal petition.

In the light of the submissions made by both the learned counsel and a perusal of the material available on record, it appears that the petitioner is in jail since 03.03.2026. As seen from the record, the material part of the investigation has been completed and L.Ws.1 to 10 witnesses have been examined.
Considering the facts and circumstances of the case and the incarceration period of the petitioner, this Court deems it fit to grant bail to the petitioner, subject to the following conditions: i.
The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each, with two sureties for a like sum each to the satisfaction of the PJCJcum-XI Judicial Magistrate of First Class, Medchal-Malkajgiri, Kukatpally.
ii.
The petitioner shall appear before the concerned SHO at 11:00 a.m., on
every Monday for a period of eight (8) week or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.
iii.
The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C.(presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
