THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No. 8520 OF 2009 O R D E R:

This Writ Petition was filed challenging the action of the respondents in not disposing of the application dated 09-11-1989 filed under Section 28-A of the Land Acquisition Act, 1894 (for short, 'the Act'), to re-determine the compensation in terms of the order in L.A.O.P.Nos. 125 and 139 of 1983 passed by learned Senior Civil Judge, Kadapa, dated 10-08-1989. 2.

The petitioners submitted representation on 09-11-1989. This Court, by order dated 24-04-2009, directed the respondents to dispose of the application dated 09-11-1989 filed under Section 28-A of the Act. Now, a counter affidavit is filed along with W.V.M.P.No. 4064 of 2010 stating that the applications were already disposed of through an endorsement given by the Special Deputy Collector in proceedings dated 20-07-1996 stating that the applicants are not entitled for re-determination of the compensation under Section 28-A of the Act as they have already availed the remedy after reference under Section 18 of the Act.

In view of the disposal of the representation of the petitioners as aforesaid, this Writ Petition is declared infructuous and giving liberty to the petitioners to take appropriate proceedings in accordance with law if the petitioners are aggrieved.

The Writ Petition is, accordingly, dismissed as infructuous. Pending miscellaneous petitions, if any, in this Writ Petition shall stand dismissed in consequence. No order as to costs.
