THE HON'BLE SRI JUSTICE SANJAY KUMAR CIVIL REVISION PETITION NO.3690 OF 2016

O R D E R

This civil revision petition was entertained owing to the fact that the petitioner herein who had suffered an adverse judgment in O.S.No.171 of 2015 on the file of the learned Principal Junior Civil Judge, Ranga Reddy District at L.B.Nagar, was unable to file an appeal thereagainst owing the agitation in the subordinate Courts in the State of Telangana at that point of time. By order dated 29.07.2016, this Court took note of this fact and observed that as the petitioner may have been deprived of his lawful right of securing interim relief in the appeal owing to this factor, there shall be interim stay as prayed for, pending further orders.

Notice having been ordered, Smt. Mammu Vani, learned counsel, entered appearance for the respondents. Sri Kiran Kumar Vadlamudi, learned counsel for the petitioner, would state that after the passing of the interim order by this Court, the appeal filed by his client was taken on file by the learned XIII Additional District and Sessions Judge, Ranga Reddy District at L.B.Nagar, in A.S.No.193 of 2016 and interim orders of status quo were passed therein. Smt. Mammu Vani, learned counsel, would contend that this Court was misled to believe that the petitioner was inconvenienced by the agitation in the subordinate Courts in the State of Telangana at the relevant point of time and assert that the petitioner was in fact attending the Court at that point of time also. This Court is not inclined to go into this aspect of the matter as an appeal has already been filed by the petitioner against the

judgment and decree in O.S.No.171 of 2015 on the file of the learned Principal Junior Civil Judge, Ranga Reddy District at L.B.Nagar, and it is for the parties to work out their remedies in the said appeal. The civil revision petition is accordingly closed. It is made clear that this Court has not gone into the merits of the matter and the appellate Court is at liberty to decide the matter on merits and in accordance with law, uninfluenced by the interim order granted by this Court in the present CRP. Interim order dated 29.07.2016 shall stand vacated. Pending miscellaneous petitions shall also stand closed in the light of this final order.
