THE HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO Writ Petition No.21361 of 2015 ORDER:

The petitioner was appointed as permanent fair price shop dealer of shop No.116 of Putlampalli Village, Kadapa Mandal and District. While so, a show cause notice was issued to the petitioner on 07.02.2011 to which she submitted her explanation on 23.02.2011. The show cause notice relates to the allegation that the petitioner failed to remit the demand drafts for essential commodities for a long time. She submitted the explanation stating that she was suffering from lung diseases and was taking treatment. When she submitted a demand draft to the Tahsildar, Kadapa, he did not accept the same and he submitted a report to the third respondent-Revenue Divisional Officer, Kadapa stating that alternative arrangements were already made. The third respondent did not accept the explanation submitted by the petitioner and cancelled her authorization, by order dated 11.07.2011.

The petitioner appears to have filed an appeal before the Joint Collector and the same was rejected as time barred on 23.01.2012. Thereafter, one Sri Kotapati Subba Reddy appears to have submitted a representation on her behalf before the second respondent-District Collector, Kadapa, seeking to set aside the orders of the third respondent dated 11.07.2011 and the second respondent passed an order on 20.06.2013 stating that the original dealer was not interested in the fair price shop dealership and a benami person is showing interest to run the fair price shop. Accordingly, the second respondent dismissed the revision petition. Challenging the said order, the present writ petition is filed.

The revision before the second respondent was filed against the order dated 11.07.2011 passed by the third respondent but not against the order passed by the Joint Collector dated 23.01.2012 rejecting the

appeal preferred by the petitioner as time barred. The order of the second respondent dated 20.06.2013 discloses the above fact. The revision was filed by Sri Kotapati Subba Reddy on behalf of the original dealer and the original dealer did not choose to file any revision.

In the circumstances, this Court sees no ground to interfere with the order passed by the second respondent, dated 20.06.2013. Accordingly, the writ petition is dismissed. Miscellaneous Petitions, if any pending in this writ petition, shall stand closed. No order as to costs.
