THE HON'BLE SRI JUSTICE A.SHANKAR NARAYANA CRIMINAL PETITION No.973 of 2017 ORDER:
The present petition, under Section 482 of the Code of Criminal Procedure, (Cr.P.C.), is filed by the petitioner/Accused requesting to quash the proceedings in Crime No.52 of 2017 on the file of SHO, P.S. Sircilla, Rajanna Sircilla District.
The petitioner, who is arraigned as accused in the aforesaid crime, alleged to have committed an offence punishable under Section 354-A of the Indian Penal Code (IPC) and Section 12 of POCSO Act 2012.
Heard Sri Venkateshwara Varanasi, learned counsel for the petitioner, and the learned Additional Public Prosecutor for the State of Telangana on behalf of respondents.
The complaint allegations are perused. It is alleged that the petitioner was showing certain videos to the children in YOUTUBE which ought not to have done and the relevant details as to the nature of videos are mentioned in the complaint lodged by the Maths teacher working in Theegalaguttapalli, Kasthuribha School. It is not a case where it can be said that investigation can be stalled or quashed for such offences.
Accordingly, the Criminal Petition is dismissed at the stage of admission itself. It is needless to mention that the Investigating Officer would follow the procedure under Section 141-A of Cr.P.C during the course of investigation.
Miscellaneous applications, if any pending in the present petition, stand closed.
