HON'BLE SRI JUSTICE S.V. BHATT Writ Petition No.19332 of 2017 ORDER:

Heard Sri K.S. Murthy, for petitioners and the Assistant Government Pleader (Revenue) for respondents 2 to 4.

2. The petitioners challenge the impugned orders No.RCA 162/ 2017 dated 16.05.2017, as illegal and unsustainable.

3. The petitioners allege that on 02.06.2017, the petitioners have already availed the remedy of appeal against the order impugned in the writ petition. One of the reasons for invoking the jurisdiction of this court is that the Appellate Authority is not passing the orders on the stay application moved by petitioners and at the same time, respondents 3 and 4 are taking steps to dismantle the bore well and to disconnect the power supply.

4. I have perused the material available on record. This court is satisfied that during the pendency of the application filed by the petitioners for interim relief, if the physical features of bore well etc. are changed, the petitioners suffer loss and hardship.

5. Hence, the writ petition is disposed of by this order. (1) The Appellate Authority is directed to dispose of the application filed by the petitioners for the interim relief within four weeks from the date of receipt of a copy of this order.

(2) The parties are directed to maintain status quo in all aspects for a period of six weeks from today. (3) The petitioners are given liberty to file a memo by enclosing a copy of this order for a date in the stay application moved in this behalf.

No order as to costs. Pending miscellaneous petitions if any in this writ petition shall stand dismissed in consequence. ____________ S.V.BHATT, J Date: 15.06.2017 BSS
