THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.13220 of 2017 ORDER:

The petitioner complains against inaction of 2nd respondent in concluding the survey undertaken through an undated notice but proposing to conduct survey on 14-05-2016 as illegal and amounts to refusing to exercise the jurisdiction vested in him. The petitioner has been making efforts for survey and demarcation of an extent of Ac .1-03 gts. In Sy.No.119-2 of Manesamudram Village. The Mandal Surveyor issued notice to the father of the petitioner and neighbouring land owners. It appears from the averments in the writ affidavit that nothing concrete has happened thereafter. Hence, the writ petition.

After perusing the material papers and hearing the learned counsel, I am satisfied that by issuing a notice, the Mandal Surveyor has set in motion the steps for initiating enquiry under the A.P.Survey and Boundaries Act, 1923. The expectation of petitioner is that survey, demarcation etc ., are to be c ompleted and report be communicated to him. As nothing to that effec t has happened, the writ petition is filed and the grievance is legitimate. Therefore, having regard to the fact situation

particularly a notice since is already issued, the writ petition is disposed of by this order.

(a) The petitioner is given liberty to submit a representation by enclosing a copy of this order as well as notice marked as Ex.P-1 to 2nd respondent within four weeks from today.

(b) The 2nd respondent is direc ted to do what all is required for getting the survey in terms of notice referred to above within a further period of two months thereafter and communicate the outcome of such survey to petitioner.

The writ petition is disposed of accordingly. No order as to costs.
