HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN Writ Petition No.20111 of 2011 ORDER:

The relief sought for in the Writ Petition is to issue a mandamus declaring the action of the respondents, in insisting on the petitioners submitting certificates namely EPF, ESI, Service Tax together with Annual Returns for the financial year 2009-10 in terms of the conditions of the tender schedule bearing Tender Notice No.A/Tender-07/2011 issued by the respondent, as arbitrary and illegal. Interim relief was sought to direct the respondents to receive the petitioner's tender without insisting on the petitioner complying with the requirements of the tender notification viz., proof of payment of service tax along with registration certificates from EPF, ESI etc.

Interim directions were granted directing the respondents to receive the petitioner's tender without insisting on their compliance with the requirements of a registration certificate from EPF, ESI, Service Tax etc. By the order in WVMP No.3277 of 2011 in WPMP No.24368 of 2011 dated 06.03.2012, the interim order granted earlier was made absolute. In the light of the interim order passed on 18.07.2011, the petitioner's application must have been considered. The tender itself was for the period 2011-12 and 2012-13 which expired nearly five years ago. It is evident that the cause in the Writ Petition does not survive necessitating any further adjudication by this Court, and the Writ Petition has become infructuous.

The Writ Petition is, accordingly, dismissed as infructuous. The Miscellaneous Petitions pending, if any, shall also stand dismissed. No order as to costs.
