Syed Inayat Ali, v. The State Of Telangana, Represented By Its Principal
THE HONOURABLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.25645 of 2014 ORDER:
There is no representation on behalf of the petitioner. 2.
The prayer sought in the writ petition is as under:- "....to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus, declaring the inaction of the 4th respondent in not registering a crime for the complaint dated 06.08.2014, which are illegal, arbitrary, highhanded and against the principles of natural justice, and consequently direct the respondents No.2 to 5 to take immediate action by register a criminal case and investigation against the 6th respondent and his henchmen for the complaint dated 06.08.2014 made by the petitioner, and to pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the above in the interests of justice."
3.
Learned Government Pleader appearing for the respondents 1 to 5 brought to the notice of this Court that pursuant to the complaint, dated 06.08.2014, a case in Crime No.237 of 2014 was registered. Pursuant to the registration of the crime, investigation was completed and final report was filed on 31.03.2015 referring the case as 'lack of evidence'.
4.
When this Court questioned as to serving of notice on the petitioner regarding filing of the final report, learned Government Pleader is unable to answer.
5.
In that view of the matter, this Court is of the view that since a crime is already registered, no further cause would survive in the writ petition.
6.
Accordingly, the writ petition is closed. However, if the petitioner has got any objections or grievance on the final report, he is at liberty to file an application or file a protest application before the concerned Court as per law. No order as to costs. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
