HON'BLE SRI JUSTICE S. RAVI KUMAR CIVIL REVISION PETITION No.405 of 2012 ORDER:

This revision is preferred challenging order dated 15.12.2011 in I.A.No.430 of 2011 in F.C.O.P.No.45 of 2010 on the file of Judge, Family Court, Kurnool.

2. Petitioner/husband filed application in I.A.No.430 of 2011 on the file of Judge, Family Court, Kurnool seeking a direction to refer respondent/wife to any Medical Board to ascertain her mental status and decide the alleged mental illness. Court below on a consideration of contentions and rival contentions of both parties dismissed the above referred I.A.No.430 of 2011. Challenging the same, present revision is preferred.

3. When this matter has come up on 29.01.2016, on the request of advocate for petitioner, the matter is posted to this date. In spite of posting the matter to this date on their request, neither petitioner counsel is present nor any representation is made on behalf of petitioner.

4. Advocate for respondent is present.

5. Considering these aspects, I am of the view that petitioner is not interested in prosecuting the case.

6. Hence, this Civil Revision Petition is dismissed for nonprosecution. No costs. Miscellaneous petitions, if any pending, in this revision shall stand closed.
