The petitioner is aggrieved of the action of 2nd respondent in continuing mining operations by the 2nd respondent in respect of the land in Survey No.405 of Kodugal village, Jadcherla mandal, Mahabubnagar, and issuing despatch permits dated 12.05.2019, in favour of 3rd respondent though the ownership right over the subject land is sub judice before this Court in a batch of writ petitions, and in spite of stay granted by this Court for carrying out mining operations in the subject land. 2.

Prima facie the allegation in the writ petition is that the respondents are violating the orders of this Court and therefore, the proper course of action for the petitioners is to move a petition with respect to violation of the orders of this Court; and prima facie a writ does not lie in such kind of cases.

In that view of the matter, the writ petition is dismissed, however, with liberty to the petitioners to move appropriate petition before this Court with respect to the alleged violation of the orders of this Court by the respondents. No costs. Miscellaneous petitions, if any pending, shall stand closed.
