HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.11530 of 2015 ORDER:

Petitioner filed this Writ Petition seeking to declare the action of the 1st respondent-Revenue Divisional Officer, Kothagudem, in not disposing of the case LTR Case No.1 of 2013 as arbitrary and illegal, and consequently to direct the 1st respondent to dispose of the same at an early date. The grievance of the petitioner is to the effect that the 1st respondentRevenue Divisional Officer, Kothagudem, Khammam District, the designated authority under the Andhra Pradesh Scheduled Areas Land Transfer Regulation, 1 of 1970, had filed L.T.R.Case No.1 of 2013 before the designated authority seeking relief of ejectment of the respondents, who are respondents 2 to 7 herein (in Writ Petition), from the petition schedule property and put the petitioner in possession of the same after demolishing the illegal constructions.

It is the case of the petitioner that the respondents had also filed their counter and the trial also completed and arguments were heard eight months back. Learned counsel for the petitioner submits on instructions of his client that the Revenue Divisional Officer, who heard the arguments in L.T.R.Case No.1 of 2013 is the Officer, is still holding the post. Therefore, he seeks a direction to the 1st respondent to pass orders. Considering the nature of the relief which is sought by the petitioner and a specific averment in the affidavit, the interest of justice would be served if a direction is issued to the 1st respondent to pass orders in LTR Case No.1 of 2013, said to have been reserved for orders, within a period of six weeks from the date of this order.

With the above direction, the Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this Writ Petition, shall stand closed.
