HON'BLE SMT. JUSTICE KONGARA VIJAYA LAKSHMI W.P. No. 13863 of 2015 O R D E R:- This writ petition is filed for the following substantive relief:
" ....to issue a Writ of Mandamus declaring the inaction of respondent Nos.2 to 4 in considering the request of the petitioner for affecting repairs at his own cost including laying of roof for the shop bearing Door No. 11/ 49 situated at Nadim Thiruvuru, Tiruvuru Village & Mandal, Krishna District in spite of the latest representation dated 21.04.2015, as arbitrary and illegal, and consequently direct respondent Nos.2 to 4 to consider the petitioner's representation."
The 4th respondent has filed counter affidavit inter alia stating that the licence of the petitioner expired on 31.12.2014; and after its expiry, the 4th respondent issued notice dated 09.06.2015 to the petitioner proposing to conduct auction on 19.06.2015; meanwhile, the petitioner filed the present writ petition seeking a direction to respondent Nos.2 to 4 to consider his representation dated 21.04.2015; and the said representation was considered and rejected by the Manager of the 4th respondent on the ground that the petitioner is not the owner of the site belonging to the Temple and his licence already expired.
In view of the specific averment made in the counter affidavit that the representation dated 21.04.2015 made by the petitioner, was already rejected by the Manger of the 4th
KVL,J WP_13863_2015 respondent, no further orders are required to be passed in this writ petition.
Hence, the writ petition is closed as no further are necessary. No order as to costs.
As a sequel, Miscellaneous Petitions, if any pending, shall stand disposed of as infructuous.
