THE HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION NO. 2740 of 2019 ORDER :

This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973, is filed by the petitioner/ A.8, for grant of anticipatory bail in Crime No.35 of 2019 of Kamatipura Police Station, Hyderabad, registered for the offence punishable under Section 8(c) read with Section 21(b) of NDPS Act. 2.

Heard the learned counsel for the petitioner/ A.8, the learned Additional Public Prosecutor representing the respondent-State and perused the record.

Learned counsel for the petitioner/ A.8 submits that Kamatipura police falsely implicated the petitioner as A.8 in the said crime; that the police officials are making efforts to know the whereabouts of the petitioner; that if he is arrested, he would be subjected to third degree method; that the petitioner is no way connected with the said offence; that though the name of one Syed Amer Ali, S/ o Syed Anwar was arrayed as A.8 in the said crime, the police officials are threatening the petitioner to admit the guilt of the alleged offence. 4.

The learned Additional Public Prosecutor contends that according to the First Information Report, the petitioner has purchased 10 grams of contraband from A.2 and A.3 and involved in the offence punishable under Section 8(c) of NDPS Act and that he is not entitled for anticipatory bail. 5.

Looking into the gravity of the offence and other circumstances, this Court is not inclined to grant anticipatory bail to the petitioner. However, if the petitioner/ A.8 surrenders before the concerned Court, his application for bail can be considered on the same day.
