The case of the petitioner is that he is the owner of the property situated at new D.No.395 (Old D.No.745) ward No.12, Narayanaraopet, Nellore Municipal Corporation, Nellore Town, Nellore District having purchased the same through registered sale deed dated 29-01-2016 and constructed a house in the said land after obtaining building permission vide BA.No.1031/0369/B/NMC/NPT/2016, dated 21-05-2016 from the respondent-authorities.

The respondentauthorities issued impugned notice impugned notice dated 04-05-2017 under Section 452 of Hyderabad Municipal Corporation Act, 1955 to the petitioner and he has submitted his explanation dated 08-05-2017. Without passing any orders on the same, the respondentauthorities are trying to demolish the petitioner's above property. Aggrieved by the same, the present writ petition is filed.

Heard learned counsel for the petitioner and learned Standing Counsel for the respondents 2 and 3. In view of the above facts and circumstances of the case, the 2nd respondent is directed to consider the explanation of the petitioner dated 08-05-2017 and pass

orders in accordance with law after issuing notice to the petitioner. Till passing of orders, there shall be stay of demolition of the subject property.
