THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.23491 of 2010 ORDER:

This writ petition was filed challenging the action of respondents 2 and 4 in interfering with civil disputes between the petitioner and respondent No.5 by directing the petitioner to settle the dispute by handover the lands to an extent of Ac.6.67 cents in Survey Nos.177-2 to 177-6 in Kothapalem Village, Buchinaidukandriga Mandal, Chittoor District to respondent No.5. A counter affidavit is filed by respondent No.2 stating as follows:

"As of now, no complaint whatsoever is received or registered against the petitioner herein. I submit that the petitioner has never approached this respondent nor lodged any complaint against the 5th respondent herein. I submit that this respondent never summoned the petitioner not interfered with the peaceful possession and enjoyment of the lands in question situated at Buchinaidukandriga Police Station limits. I submit that there is no necessity for this respondent to ask the petitioner to settle civil matters with the 5th respondent. I humbly submit that the subject lands of the petitioner herein are situated at Buchinandigukandriga Police Station limits which is no way concerned with this respondent. At no point of time, this respondent asked the petitioner to hand over the subjects to the 5th respondent herein. I submit that the dispute of the petitioner as well as the 5th respondent is purely civil dispute and his respondent has nothing to do with it. To settle his personal scores with the 5th respondent, the petitioner made baseless allegations against this respondent herein."

In view of the above and in the absence of any other material justifying the relief sought for in this writ petition, no relief can be granted in this writ petition.

Accordingly, this Writ Petition is dismissed. No order as to

costs. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
