Heard learned counsel for the petitioners and learned Government Pleader for the respondents.

The petitioners are all petty vendors and erected shops more than two decades ago on the embankment of Rivar Canal, NTS No.1015 and NTS No.1013 belonging to Irrigation Department. While so, the respondents issued notices to vacate the premises occupied by them on the ground that the land belongs to the Irrigation Department. Challenging the said notices and claiming rights under The Street Vendors (Protection of Livelihood and Regulations of Street Vending) Act 7 of 2014 dated 04.03.2014, the present writ petition is filed. A perusal of the notices issued by the respondents indicate that they were issued for modernizing the canal and beautifying the same. If the petitioners have any claim over the land, they are at liberty to file objections to the notices issued by the 2nd respondent.

In these circumstances of the case, the writ petition is disposed of giving liberty to the petitioners to file their objections within a period of 15 days from the date of receipt of a copy of this order and the respondents shall consider the same and pass appropriate orders thereon within a period of four weeks thereafter. The respondents shall not take any action for their eviction till final orders are passed. There shall be no order as to costs. Pending miscellaneous petitions in this Writ Petition, if any, shall stand closed in consequence.
