HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.16021 OF 2017 ORDER:

The case of the petitioner is that he made representation dated 13-03-2017 for mutating his name in revenue records like adangal as well as on-line digital entries in respect of his land to an extent of Ac.25-00 guntas in Sy.No.90/vow/16 at Uppusaka Village, Burgampadu Mandal, Palvancha Revenue Divisional, Badradri Kothagudem District and so also the petitioner made representation dated 16-09-2015 to the 6th respondent for issuing 'No Objection Certificate' in respect of above said land. But no orders are passed on the same. Aggrieved by the inaction of the respondents 2 to 4 and 6th respondent respectively, the present writ petition is filed.

Heard learned counsel for the petitioner, who submits that several representations were submitted in the year 2012 by the petitioner and others to the respondent-authorities to finalize the dispute between the Forest and Revenue for identifying the patta lands in Sy.No.90 of Uppusaka Village and the 5th respondent also submitted report on 14-07-2012. Learned Government Pleader for Forest as well as Learned Assistant Government Pleader Revenue submits that under the guise of grant of pattas, the petitioner and others are trying to encroach the forest land by obtaining orders from this Court.

It is to be seen that this writ petition is filed for consideration of representation dated 13-03-2017 made by the petitioner. In view of rival contentions, it is open for the respondents 2 to 4 to conduct survey and also identify the forest land and land belonging to the petitioner in the presence of the petitioner as well as the Forest department officials and thereafter, take necessary action on the representation of the petitioner dated 13-03-2017. The allegation of the petitioner is that the Forest Department is not allowing the petitioner to cultivate the lands. The Government Pleader for Forest vehemently submits that the officials are only protecting the forest lands. In view of the same, till the representation, dated 13-03-2017 of the petitioner is disposed of, status-quo regarding possession over the subject land shall be maintained by both the parties.

Accordingly, this writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
