HON'BLE SRI JUSTICE U.DURGA PRASAD RAO Criminal Petition No.3292 of 2018 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C., by the petitioners/A.1 and A.2, who are the husband and wife seeking to quash the proceedings in Crime No.928 of 2017 of Bobbili PS, Vizianagaram District, registered for the offences under Sections 406, 420 r/w 34 IPC. 2) Investigation is reported to be in the nascent stage. 3) Heard learned counsel for petitioner.

4) Having regard to the prima facie accusation found in the complaint, it is not apt to quash the proceedings. Hence, investigation shall go on. However, having regard to the nature of the offences, the Investigating Officer shall strictly follow the procedure contemplated under Section 41-A Cr.P.C during the course of investigation towards the petitioners/A.1 and A.2 and petitioners shall also cooperate with the investigating agency for smooth completion of investigation.

5) Accordingly, this Criminal Petition is disposed of. As a sequel, miscellaneous applications pending, if any, shall stand closed.
