HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.20047 of 2015 ORDER :

With the consent of both the parties, the writ petition is disposed of at the admission stage.

2. The writ petition is filed questioning the action of the 4th respondent-Tahasildar, Tripurantakam Mandal, Prakasam District, in threatening to dispossess the petitioner from his lawful possession in respect of the land admeasuring Ac.1.08 cents and Ac.2.00 cents in Sy.Nos.512 and 557/3 respectively situated at Mittalpalem Village of Tripuranthakam Mandal, Prakasam District, without issuing any notice and without following the due process of law.

3. The petitioner states that he is a landless poor person and the revenue officials assigned the above subject land to him about 20 years back. It is further stated that the revenue officials issued pattadar pass book and title deeds in his favour and since then he is in possession and enjoyment of the same. It is alleged that due to the formation of new State of Andhra Pradesh, the value of the lands have increased and as such, the 4th respondent under influence of local persons is trying to dispossess him from the said land. According to the petitioner, the 4th respondent came to his land on 10.06.2015, demanded him to vacate the subject land

and hand over the possession of the same. Hence, the writ petition seeking protection from dispossession.

4. Learned Government Pleader for Revenue opposed the petition contending that the allegations made in the writ petition are false.

In view of the claim made by the petitioner that he is in possession of the land since 20 years and that pattadar passbooks and title deeds were also issued in his favour, the present writ petition is disposed of directing the 4th respondent not to take any coercive steps against the petitioner, except in accordance with law, if he is in possession of the subject land. There shall be no order as to costs.

6. Miscellaneous petitions pending, if any, shall stand closed.
