THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.37624 of 2016 ORDER :

Petitioners are aggrieved by non-implementation of decision of respondents 3 and 4 in taking action against illegal constructions made by the 5th & 6th respondents. 2.

When the matter is taken up, learned Standing counsel representing GHMC, submits that challenging the proceedings dated 03.08.2016 some other persons instituted W.P.No.32467 of 2016 and this Court granted interim stay in W.P.M.P.No.40165 of 2016 by order dated 28.09.2016.

In view of the fact that the proceedings of 03.08.2016 are already under challenge before this Court, the prayer sought in this writ petition cannot be granted and the writ petition is liable to be dismissed.

Accordingly, the Writ Petition is dismissed. However, liberty is granted to the petitioners, if so advised, to seek impleadment in W.P.No.32467 of 2016 and to contest the claim made by the petitioners therein. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
