THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.38391 of 2015 ORDER :

The petitioner was appointed as Associate Professor of Dentistry, in Rajiv Gandhi Institute of Medical Sciences, Kadapa vide proceedings dated 19.01.2011. The order of appointment indicates that it is on tenure basis for a period of four years and the contract of appointment would be terminated on completion of fixed tenure as indicated in the order or on completion of 65 years of age whichever is earlier. By the impugned letter dated 29.10.2015 the petitioner's services are terminated giving effect to the terms of the order of appointment.

Learned counsel for the petitioner contends that there are several doctors appointed in similar manner, and their services are continued, even though their fixed tenure was over, whereas the services of the petitioner are dispensed with. He further contends that still there is a need and necessity of the position held by the petitioner and there is no justification to discontinue the services of the petitioner.

3. As seen from the order of appointment, the norms of appointment are very clear and therefore, I see no illegality in the order impugned in this writ petition. However, if what is contended by the petitioner is true, and if there is still requirement of the position held by the petitioner, it is open to the petitioner to make a representation to the respondents and the respondents shall consider the said representation and decision to this extent shall be taken objectively. If for any reason the request of the petitioner for further continuation is not granted, a reasoned order shall be passed. A decision to this effect shall be taken and communicated to the petitioner within a period of three (3) weeks from the date of submission of representation by the petitioner.

4. With the above directions, the writ petition is disposed of. There shall be no order as to costs.
