This writ petition is filed for the following relief; "............... to issue a Writ of Mandamus or any other appropriate Writ, Order or Orders, direction or Direction to direct the 1st respondent to act in accordance with law and not to proceed in any manner by way of coercive measures against the petitioner for recovery of amount due under the order passed by him dt.26.03.2019 in TS/RO/HYD/7A Enquiry/AP/ 56436/2018, till the disposal of the stay petition in the Appeal pending in Dairy No.331 of 2019 on the file of Central Government Industrial Tribunal, Hyderabad, filed by the petitioner, and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."
The grievance of the petitioner is that they have filed appeal before the Central Government Industrial Tribunal, Hyderabad, under Section 7-I of the Employees Provident Fund and Miscellaneous Provisions Act, 1952, which is numbered as Dairy No.331 of 2019 along with stay petition; that since the Tribunal is on vacation, present writ petition is filed; and that even after re-opening of the Tribunal, the Presiding Officer is on leave and he is going to join on 14.06.2019. Heard Sri T.Balaji, learned Standing Counsel for respondents 1 and 2.
In view of the aforesaid facts and circumstances, no useful purpose would be served in keeping the writ petition pending. As such,
the writ petition is disposed of directing the Central Government Industrial Tribunal to take up the interim application in the appeal, as expeditiously as possible within a period of four weeks from the date of receipt of a copy of this order. Till disposal of the interim application, the interim order granted on 22.05.2019 will be in operation. Petitioner shall cooperate in disposal of the interim application. No order as to costs.
As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
