Heard Sri V.Raghu for petitioners and Sri D.Ramesh for 2nd respondent.
The petitioners pray for Mandamus declaring the action of respondents 2 and 3 in laying road through petitioner's plot in R.S.No.366/ 2 of Sri Ramchandra Nagar, Gunadala, Vijayawada as illegal, arbitrary and unconstitutional.
The counsel for respondents submits that on a clear misapprehension the present writ petition is filed. According to instructions received by him, the land in which road is laid has been shown, as such, the petitioners have in fact encroached 22 feet of road. Admittedly, on 27-10-2016, the petitioners have represented to respondents for enquiry and redressal of their grievance. This Court is of the view that particularly having regard to the case pleaded by petitioners and stand of respondents, the matter requires enquiry. Hence, the 3rd respondent is directed to examine the representation for boundaries of road by conducting survey, conduct enquiry and pass appropriate orders within two weeks from today. The writ petition is accordingly disposed of. No order as to costs. Miscellaneous petitions, if any, pending, shall stand closed. _____________ S. V.
