HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No. 17202 of 2014 Order:
This Writ Petition was filed seeking a Writ of Prohibition in respect of the prosecution launched against the petitioners in STC No.197 of 2014 before the XII Additional Metropolitan Magistrate, Nampally, Hyderabad. This Court, while admitting the Writ Petition on 25.06.2014, granted interim stay of all further proceedings, as a result of which the proceedings are stayed. Now, the prosecuting authority itself wanted to withdraw the proceedings, for which purpose a letter was addressed to the Commissioner of Labour, Government of Telangana, Hyderabad on 25.01.2017. In response to the said letter, the Commissioner issued a memo No.G2/950/2017, dated 10.03.2017, permitting the Joint Commissioner of Labour, Hyderabad, Twin Cities, to take further action by following necessary procedure as requested by him under intimation to his office.
The Joint Commissioner of Labour, Hyderabad, in turn, issued proceedings on 15.03.2017 directing the Assistant Commissioner of Labour-III, Hyderabad, to initiate further necessary action in respect of ten (10) cases including the case in STC No.197 of 2014. In the circumstances, in view of the stand taken by the official respondents, no further orders are necessary in the present Writ Petition, but liberty is given to the fourth respondent to take further action, pursuant to the communication of the third respondent, in accordance with law. The Writ Petition is, accordingly, disposed of in order to facilitate the fourth respondent to take further action, but in the guise of further action the petitioners shall not be called to attend the case. There shall be no order as to costs.
As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
