Heard the learned counsel for the petitioner and the learned Government Pleader for Revenue, appearing for respondent Nos.1 to 3.

Petitioner is respondent No.9 in the proceedings pending before the 3rd respondent-RDO & Land Reforms Tribunal, Kandukur Division, Ranga Reddy District. He was served notice on 20-04-2019 directing the petitioner to appear on 27-04-2019 for enquiry. Thereafter, it was adjourned to 25-05-2019. Petitioner filed a Memo requesting to grant four weeks' time to secure the certified copies and enable him to file counter. Petitioner also filed an application to supply the docket proceedings in File No.B/2511/2018. 3.

This Writ Petition is filed alleging that without giving due opportunity of hearing and without enabling the petitioner to file counter, 3rd respondent is proceeding for enquiry and in such an event, grave prejudice would be caused to the petitioner. In the Writ Petition, petitioner sought to direct the 3rd respondent to refrain from proceeding further in the mater for a period of eight weeks so as to enable the petitioner to file counter/suitable reply and to contest the matter.

On 22-05-2019, the Court granted interim direction for a period of six weeks.

When the prayer sought by the petitioner was to grant only four weeks' time before the 3rd respondent and sought eight weeks' time in this Writ Petition for filing counter, and even now, no counter is filed, I do not see any bona fidies on the part of petitioner in prosecuting the litigation. However, as a final chance, the petitioner is granted three weeks' time from today to file counter before 3rd respondent. If counter is not filed within the time granted, it is open for the 3rd respondent to proceed with the matter based on the material on record.

Accordingly, the Writ Petition is disposed of. Pending miscellaneous petitions shall stand closed.
