THE HON'BLE SRI JUSTICE K.C.BHANU WRIT PETITION No.14560 of 2015 ORDER:

The relief sought for in this writ petition is to declare the order passed by the 2nd respondent in R.C.No.A7/551/2015 dated 18.04.2015 temporarily suspending the authorization of the petitioner as illegal and arbitrary.

Learned counsel for the petitioner contended that a show notice dated 18.04.2015 was issued to the petitioner granting seven days time to show cause as to why her authorization should not be cancelled for contravention of Clause 17 (b) & (c) of the A.P. State Public Distribution System (Control) Order, 2008 (for short 'the Control Order") and that even before the expiry of the stipulated time, the impugned order dated 18.04.2015 was passed temporarily suspending her authorization.

The show cause notice dated 18.04.2015 relates to cancellation of the authorization, whereas the impugned order dated 18.04.2015 in R.C.No.A7/551/2015 was passed temporarily suspending the authorization of the petitioner pending enquiry as per Clause 5(5) of the Control Order, 2008. Therefore, the contention of the learned counsel for the petitioner cannot be accepted and the writ petition is liable to be dismissed. However, in pursuance of the show cause notice dated 18.04.2015 with regard to cancellation of authorisation, the petitioner claims to have submitted her explanation. Therefore, the writ petition is disposed of, directing the authority concerned to pass appropriate orders taking into consideration the explanation submitted by the petitioner within a period of four weeks from the date of receipt of a copy of this order. The miscellaneous petitions pending, if any, shall also stand disposed of. There shall be no order as to costs.
