Heard learned counsel for petitioner and the learned Government Pleader for Home appearing for respondents. The petitioner's allegation is that petitioner's vehicle bearing temporary Registration No.TS09 CDTR 7570 has been detained illegally by respondent No.3 on the ground that driver of the said vehicle was drunk.
The Government Pleader for Home appearing for respondents states that the vehicle was seized on 11.05.2019 as the driver was not in a position to drive the vehicle and so the vehicle was detained.
Even if the driver on that particular day was unable to drive the vehicle, that does not mean that respondents can retain the vehicle.
Therefore, the petitioner is directed to appear before respondent No.3 with RC Book relating to the said vehicle and also by producing proof of his identity and thereupon respondent No.3 or other official, who has the custody of the vehicle in question, shall release the said vehicle to the petitioner forthwith.
The Writ Petition is accordingly disposed of. No order as to costs.
Consequently, Miscellaneous Petitions pending if any, shall stand closed.
