THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO. 2650 OF 2022 O R D E R:

This Criminal Petition is filed under Section 438 of the Code of Criminal Procedure, 1973 (for short "Cr.P.C.") seeking pre-arrest bail to the petitioners/Accused Nos.2, 3 and 4 in the event of their arrest in connection with Crime No.171 of 2022 on the file of Station House Officer, Gachibowli Police Station, Cyberabad registered for the offences punishable under Sections 376, 417 and 420 of Indian Penal Code (I.P.C.) and Section 3(2)(v) SC/ST POA Act. 2.

Heard the learned counsel for the petitioners and the learned Assistant Public Prosecutor for the respondent-State. Perused the record.

The petitioners are arrayed as Accused Nos.2, 3 and 4 in the aforementioned Crime.

Accused No.1 is the son of Petitioners/Accused Nos.2 and 3 and brother of petitioner/Accused No.4. The allegation against the petitioners is that Accused No.1 is alleged to have introduced himself with the de facto complainant and had love affair for the past one

and half year and he took the de facto complainant to the petitioners who are parents and sister of Accused No.1 and they agreed for the marriage. Thereafter, due to an altercation between the de facto complainant and Accused No.1, the Accused No.1 refused to marry her and the petitioners/Accused Nos.2 to 4 who have initially accepted the marriage proposal, are now supporting the Accused No.1.

According to the learned Assistant Public Prosecutor notice is served on the de facto complainant.

Since the allegations against the petitioners/Accused Nos.2 to 4 are that they were supporting the Accused No.1 who initially accepted to marry the de facto complainant and later refused, in the said facts and circumstances, the petitioners/Accused Nos.2 to 4 can be granted the relief of Anticipatory Bail.

Accordingly, the Criminal Petition is allowed subject to the following terms and conditions:

i) The petitioners/Accused Nos.2 to 4 are directed to surrender before the Station House Officer, Gachibowli Police Station, Cyberabad, within a period of ten (10) days from today, and on such

surrender, the said Station House Officer shall release the petitioners/Accused Nos.2 to 4 on bail on their executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties to the like sum each to his satisfaction ii) The petitioners/Accused Nos.2 to 4 shall appear before the investigating authorities as and when required. iii) The petitioners/Accused Nos.2 to 4 shall abide by the other conditions stipulated in Section 438(2) Cr.P.C. 7.

Miscellaneous petitions pending, if any, shall stand disposed of.
