HON'BLE SRI JUSTICE G.CHANDRAIAH AND HON'BLE SRI JUSTICE M.S.K.JAISWAL CRL.A.No.414 of 2010 JUDGMENT: (per Hon'ble Sri Justice M.S.K.Jaiswal) This appeal is directed against the judgment dated 03.12.2009 in Sessions Case No.261 of 2008 passed by the learned Sessions Judge, Mahila Court, Vijayawada, whereby the sole appellant-accused was convicted of the offences under Sections 302 and 201 I.P.C. and sentenced to undergo imprisonment for life and to pay a fine of Rs.1,000/-, in default, to suffer simple imprisonment for a period of three months, for the offence under Section 302 I.P.C. and he was further sentenced to undergo rigorous imprisonment for a period of five years and to pay a fine of Rs.1,000/-, in default to suffer simple imprisonment for a period of three months, for the offence under Section 201 I.P.C. while making it clear that the sentences imposed against him shall run concurrently.

Today, when the matter is taken up for hearing, learned Public Prosecutor, on instructions, submitted that the sole appellant-accused died, during the course of his imprisonment, on 09.11.2013 at about 6.15 A.M.

at Government General Hospital, Kakinada, while undergoing treatment.

Recording the above submission, the Criminal Appeal is dismissed as having been abated.
