THE HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.10499 OF 2019 ORDER:
The petitioner challenges action of respondent No.2 in not taking action on the complaint made by the petitioner about the illegal constructions being made by respondent No.3 over the property bearing H.No.1-12-25/3/G, Military Colony, Medak Town and District, without any valid permission, as arbitrary and illegal.
Heard learned counsel for the petitioner and Sri N. Praveen Kumar, learned Standing Counsel for the Municipalities.
It is the contention of the learned counsel for the petitioner that inspite of issuance of legal notice dt.19.05.2019 and the complaint made against respondent No.3 about the illegal constructions, respondent No.2 is not taking any action on the illegal constructions being made by respondent No.3 over the subject property bearing H.No.1-12-25/3/G, Military Colony, Medak Town and District, without any valid permission.
Having regard to the submissions made by the learned counsel for the respective parties, the writ petition is disposed of directing respondent No.2 to take into consideration the legal notice dt.19.05.2019 and the complaint made by the
petitioner with regard to the illegal construction made by respondent No.3 and if the allegations are found to be correct, respondent No.2 shall take necessary action in accordance with law after issuance of notice and calling for explanation from respondent No.3.
Miscellaneous petitions pending in the Writ Petition, if any, shall stand closed.
