THE HON'BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON'BLE SRI JUSTICE SANJAY KUMAR PUBLIC INTEREST LITIGATION No.42 of 2015 ORDER: (per the Hon'ble The Chief Justice Sri Kalyan Jyoti Sengupta) This Public Interest Litigation has been filed seeking a Mandamus to respondents 1 and 2 for taking action against respondent No.8, which is alleged to have been carrying on mining operations illegally.

It appears that this Public Interest Litigation has been filed without making any demand of justice. It is settled law that the writ of Mandamus would be issued only when demand of justice has not been addressed to or looked into. Therefore, this Public Interest Litigation is premature. This Public Interest Litigation is accordingly dismissed giving liberty to the petitioner to make a complaint before appropriate authority or authorities seeking demand of justice and thereafter, if so advised, the petitioner may approach this Court. No order as to costs.

Consequently, miscellaneous petitions, if any pending, shall stand closed.
