Smt. Obilisetti Lakshmi v. State Of Andhra Pradesh, Represented By Its Secretary,
THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.37592 of 2016 ORDER:
The present Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioner with the following prayer: "... to issue a writ or order or orders or directions more particularly one in the nature of Writ of Mandamus declaring inaction of the official respondents on petitioner's representation dated 18.05.2016, as illegal, arbitrary, biased, unconstitutional and against the principles of natural justice and consequently direct the respondent No.4 to take appropriate action on petitioner's representation dated 18.05.2016 and to pass such other order or orders as this Hon'ble High Court may deem fit, just and necessary in the circumstances of the case."
2. The grievance of the petitioner is that though the subject land was assigned to her, the official respondents, at the instance of unofficial respondents, are trying to evict her from the subject land and as such, she made a representation to respondent No.4 - Tahsildar, Bheemadolu Mandal, West Godavari District, but no action has been taken. Hence, seeks a direction to respondent No.4 to consider the representation, dated 18.05.2016, made in this regard.
3. Learned Government Pleader for Revenue submits that if the representation of the petitioner is still pending consideration, respondent No.4 may be directed to consider the same.
4. Having regard to the above submissions and without going into merits of the case, the Writ Petition is disposed of directing respondent No.4 - Tahsildar, Bheemadolu Mandal, West Godavari District, to dispose of the representation, dated 18.05.2016, of the petitioner in accordance with law, after hearing all the aggrieved persons, including the petitioner herein, at the earliest.
5. Miscellaneous Petitions, if any, pending in this Writ Petition, shall stand closed. There shall be no order as to costs. _____________________________ JUSTICE C. PRAVEEN KUMAR November 03, 2016 MD
