THE HON'BLE SRI JUSTICE P.KESHAVA RAO WRIT PETITION No.33433 OF 2013 ORDER:

There is no representation on behalf of the petitioner. The prayer sought for in the writ petition is as under: " to issue a writ order or direction more particularly one in the nature of writ of mandamus declaring the action of the respondents in harassing the petitioner is highly illegal, arbitrary, unconstitutional and consequently direct the respondent No 3 herein not to harass the petitioner."

During the course of hearing, the learned Government Pleader appearing for the respondents 1 to 3 placed on record the written instructions dated 12.12.2013 issued by the Sub-Inspector of Police, Kukatpally Police Station, Cyberabad. The same is placed on record. A perusal of the said written instructions would reveal that when the writ petition came up for hearing on 09.12.2013, this Court directed the petitioner-A.3 to approach the Station House Officer, Kukatpally Police Station on 10.12.2013 at 10.30 a.m. and further directed the Station House Officer to record the statements of A.1 and A.2. However, from the perusal of the docket proceedings, no such order has been passed by this Court. Be that as it may, it is further stated in the written instructions that in spite of the directions of this Court, the petitioner-A.

3 did not approach the Station House Officer till the date of issuance of the instructions. The respondent-police recorded the statements of A.1 and A.2 on 10.12.2013. During the interrogation, A.1 and A.2 stated that they along with the petitioner herein have committed the offence on 20.01.2011 in Crime No.100 of 2011. The copies of the statements of A.1 and A.2 are also enclosed with the instructions.

said statements would indicate that the name of the petitioner herein has also been referred by A.1 and A.2. In view of the above, this Court is of the opinion that there are no merits in the writ petition and the same is filed only for the purpose of avoiding interrogation by the respondent-police in connection with Crime No.100 of 2011.

Hence, the writ petition is dismissed. No costs. Pending miscellaneous petitions, if any, shall stand closed. ___________________ P.KESHAVA RAO,J 23rd NOVEMBER 2018.
