Petitioners claim that they own land to an extent of Ac.1.31 guntas in Sy.No.220 of Mamidipally village, Makloor Mandal, Nizamabad district. This writ petition is filed alleging that respondents are trying to dispossess the petitioners from the said land without following due process of law and the same is illegal. 2.
Learned Government Pleader, on instructions, submits that in Sy.No.220, total extent of land is Ac.13.22 guntas and entire extent of land was private patta land. Earlier Government acquired Ac.1.00 guntas of land for the purpose of construction of Sub-Station and Sub-Station was constructed and is in operation. Another extent of Ac.6.11 guntas of land was acquired for the purpose of laying Railway Line. After this acquisition, separate sub-divisions are assigned to respective extents of land and Government is not interfering with the possession and enjoyment of rest of land owned by the individuals. He would further submit that if land is required by the Government, they will follow due procedure before taking possession of land. In view of said statement of learned Government Pleader, it is clear that writ petition is filed only on apprehension and there was no cause for the petitioners to rush to this Court. Accordingly Writ Petition is dismissed.
Miscellaneous petitions, if any, pending in this writ petition shall stand closed. No costs.
