When the matter is taken up, it is brought to the notice of this Court that the issue in the present writ petition is squarely covered by the order of this Court passed in W.P.No.4254 of 2008, dated 14.11.2017 and a copy of the said order is placed on record by the learned counsel for the petitioner. 2.

Following the above said order and for the reasons recorded therein, the writ petition is allowed, setting aside the order passed by the 1st respondent vide proceedings dated 05.02.2008. However, this order will not preclude the respondents from issuing notice afresh and to proceed in accordance with law.
