THE HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.10521 OF 2019 ORDER:

The petitioners challenge the Notice dt.05.05.2019 issued by the respondents alleging that the petitioners have occupied the forest land and their activities are causing inconvenience to the wild life.

Heard learned counsel for the petitioners and the learned Government Pleader for Forests.

It is the contention of the learned counsel for the petitioners that the respondents are trying to dispossess the petitioners from the subject land and consequently sought a direction to the respondents not to interfere with the peaceful possession and enjoyment of the petitioners over the subject land.

On the other hand, the learned Government Pleader for Forests submits that the activities of Sammakka Sarakka temple being carried on by the petitioners are disturbing the environment in the locality.

Having regard to the submissions made by the learned counsel for the respective parties, inasmuch as the petitioners had already been issued notice dt.05.05.2019, liberty is given to the petitioners to submit explanation to the said notice,

which shall be taken into consideration by the respondents and pass appropriate orders in accordance with law. It is made clear that the entire exercise shall be completed by the respondents within a period of four (4) weeks from the date of receipt of a copy of this order. Till such time, no coercive steps shall be taken against the subject land of the petitioners. Accordingly, this writ petition is disposed of. No order as to costs.

Miscellaneous petitions pending in the Writ Petition, if any, shall stand closed.
