HON'BLE MRS. JUSTICE ANIS C.C.C.A.M.P.NO.318 OF 2017 AND C.C.C.A.No.214 of 2011 COMMON JUDGMENT:

C.C.C.A.M.P.No.318 of is filed by the appellant/plaintiff along with memorandum of compromise to record compromise and pass decree in terms of the memorandum of compromise.

Appellant and respondent as well as their counsel are present and they are identified by each other and respective counsel appearing on their behalf. It is pertinent to note that though the suit and appeal are defended by Sri Jitender V.Sehgal, the then Chairman of appellant-M/s.Balaji Arun Educational Society, the present C.C.C.A.M.P No.318 of 2017 is filed by Sri M.Komaraiah as the present Chairman of the said Society.

It is represented by counsel for appellant that as the sole appellant is bedridden, he appointed his son as his Special Power of Attorney Holder under Special Vakalat to represent his case. To that effect the said Special Power of Attorney is annexed along with C.C.C.A.M.P No.318 of 2017. The said Special Vakalat is placed on record. The contents of the compromise are read over to both parties. Both parties agreed voluntarily for the compromise as per the conditions of memorandum of compromise.

Therefore, in view of the compromise entered into both sides, C.C.C.A.M.P.No.318 of 2017 is allowed. Accordingly, the Appeal is disposed of in terms of the memorandum of compromise. However, it is made clear that this compromise relates only to the subject matter of the suit and appeal. No order as to costs. Miscellaneous Petitions, if any, pending in this Appeal shall stand closed. _________ ANIS, J 10.07.2017 TSNR
